End User License Agreement

Effective May 21, 2026

This End User License Agreement ("EULA") is between you and Creative Factory regarding your use of the Chiari Companion iOS application ("the Licensed Application"). By installing or using the Licensed Application you agree to be bound by this EULA. If you do not agree, do not install or use the Licensed Application.

1. Acknowledgment

You acknowledge that this EULA is between you and Creative Factory, not with Apple Inc. Creative Factory, not Apple, is solely responsible for the Licensed Application and its content. The terms of this EULA may not provide rights to Apple beyond Apple's Licensed Application End User License Agreement.

2. License grant

Creative Factory grants you a non-transferable license to use the Licensed Application on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the App Store's Usage Rules.

3. Permitted use

The Licensed Application is licensed for personal, non-commercial use as a journaling and record-keeping tool. You may not:

• Reverse-engineer, decompile, or disassemble the Licensed Application except as expressly permitted by law;
• Rent, lease, sublicense, or redistribute the Licensed Application;
• Use the Licensed Application to provide medical services to third parties;
• Use the Licensed Application in any way that violates applicable law.

4. No medical use

The Licensed Application is not a medical device. It does not diagnose, treat, cure, prevent, monitor for clinical purposes, or detect any disease or condition, and it does not provide medical advice. Any output it produces (summaries, patterns, exports) describes information you entered and must not be used as a substitute for professional medical judgment.

5. Subscriptions & in-app purchases

Some features require a paid subscription. Subscriptions are billed by Apple and managed under Apple's standard subscription terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.

6. Maintenance & support

Creative Factory is solely responsible for providing maintenance and support, as described in this EULA or as required by applicable law. Apple has no obligation whatsoever to furnish maintenance or support for the Licensed Application.

7. Warranty

Creative Factory is solely responsible for any product warranties, whether express or implied, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Creative Factory's responsibility.

8. Product claims

Creative Factory, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. Intellectual property

In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Creative Factory, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Legal compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-party beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

12. Termination

This EULA is effective until terminated by you or Creative Factory. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.
